1. Our position

DefoHub respects copyright and responds to properly made notices under the Digital Millennium Copyright Act, 17 U.S.C. §512, and equivalent law in [JURISDICTION]. Content is uploaded by independent creators who warrant that they hold the rights to it. Where we receive a valid notice, we remove or disable access to the material expeditiously and notify the uploader.

2. How to file a takedown notice

Send a written notice to our designated agent (section 3). To be effective under §512(c)(3), it must include all six of the following:

1. A physical or electronic signature of the copyright owner, or a person authorised to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are covered by one notice.
3. Identification of the material claimed to be infringing, with enough detail for us to locate it — the full DefoHub URL of each video, short, post, or image, and the timestamp if only part of a work is at issue.
4. Your contact information: name, mailing address, telephone number, and email address.
5. A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorised to act on their behalf.

Incomplete notices delay removal. We may pass your notice, in full, to the uploader and to a public transparency database; redact anything you do not want disclosed other than the elements the statute requires.

4. What happens next

• We acknowledge valid notices within 2 business days.
• Material we can identify is removed or disabled expeditiously, normally within 72 hours.
• The uploader is notified, given a copy of the notice, and told how to counter-notify.
• A copyright strike is recorded against the uploader’s account.
• Related earnings may be held pending resolution.

5. Counter-notification

If your content was removed in error or as a result of misidentification, you may send a counter-notification to dmca@defohub.com containing:

1. Your physical or electronic signature.
2. Identification of the removed material and the location where it appeared before removal.
3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, of any district in which DefoHub may be found), and that you will accept service of process from the complaining party.

We forward the counter-notification to the original complainant. If they do not notify us within 10 to 14 business days that they have filed a court action seeking to restrain the activity, we may restore the material.

6. Misrepresentation

Under §512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages and costs. Do not use this process to suppress lawful content, competitors, or criticism — abusive filers are blocked.

7. Repeat infringers

We maintain and enforce a repeat-infringer policy. A copyright strike expires 12 months after it is recorded, or immediately if it is retracted or successfully counter-notified. One strike triggers a warning; two, loss of upload and monetisation privileges; a third strike results in permanent termination of the account and of any related accounts, with outstanding balances handled under our Terms of Service. We may terminate sooner for blatant or commercial-scale infringement.

8. This is copyright only

This process handles ownership of the work. If you appear in content that was published without your consent — leaked, recorded secretly, deepfaked, or shared after a relationship ended — use our Content Removal Request, which does not require you to own the copyright.
