18 U.S.C. §2257 Compliance Statement
1. Statement
All models, performers, actors, and other persons who appear in any visual depiction of actual or simulated sexually explicit conduct made available through defohub.com were over the age of eighteen (18) years at the time the material was produced.
Records required by 18 U.S.C. §2257 and §2257A, and by 28 C.F.R. Part 75, are maintained by the primary producer of each depiction — the uploading creator or studio — and, to the extent DefoHub holds such records, by the Custodian of Records identified in section 5 below.
2. DefoHub’s role
DefoHub is a user-generated-content platform. We do not create, direct, film, commission, or edit the content published here. Content is uploaded by independent verified creators who act as the primary producers of their material and who retain the original age-verification and consent documentation for every performer.
With respect to content uploaded by third parties, DefoHub’s position is that it acts as a provider of an electronic communication or remote computing service and is not a producer within the meaning of 28 C.F.R. §75.1(c). This statement is not an admission that DefoHub is a primary or secondary producer of any specific depiction. Where DefoHub does publish material it produced itself, it maintains the full records required by §2257 for that material.
3. What we require from uploaders
Publishing on DefoHub is conditional on the creator contractually warranting, and being able to evidence, that for every performer in every upload they hold and will retain:
- A legible copy of a valid government-issued photo identification showing the performer’s legal name and date of birth.
- A record of any name, stage name, alias, maiden name, nickname, or screen name ever used by that performer.
- A signed model release and a written consent to the recording and to its publication, distribution, and sale on DefoHub.
- The date of production of the depiction, and the URL or title under which it was published.
These records must be organised so that any depiction can be matched to the performers in it, must be retained for at least seven (7) years, and must be produced to DefoHub within 72 hours of a compliance request. Content is removed and the account suspended where records are not produced. See sections 5 and 6 of our Terms of Service.
4. What DefoHub holds
For each verified creator, DefoHub retains the identity verification outcome and reference supplied by its verification provider, the creator’s certifications and warranties, upload timestamps, and the audit trail of any compliance request and response. We retain these for at least seven (7) years after the content is removed. Storage of performer identity documents is described in our Privacy Policy.
5. Custodian of Records
The Custodian of Records for material for which [LEGAL ENTITY NAME] is a producer, and the person to whom §2257 inspection requests should be directed, is:
- [CUSTODIAN OF RECORDS NAME]
- [LEGAL ENTITY NAME]
- [CUSTODIAN ADDRESS]
- compliance@defohub.com
Records are available for inspection during ordinary business hours as provided by 28 C.F.R. Part 75. Requests for records held by a specific creator are forwarded to that creator, who remains the primary producer and the custodian of their own documentation.
6. Exempt material
Material that does not depict actual or simulated sexually explicit conduct — profile photographs, trailers without explicit content, chat, and text posts — is exempt from §2257 record-keeping. It remains fully subject to our Terms, including the requirement that every person depicted is an adult who consented to appear.
7. Reporting a concern
If you believe any performer on DefoHub was under 18, or that content was published without the performer’s consent, report it immediately to compliance@defohub.com. Suspected material is removed on receipt, pending review. Suspected child sexual abuse material is preserved, reported to law enforcement and to NCMEC, and the responsible account is terminated. See our Complaint & Abuse Policy and Content Removal Request process.
